The Pickin' Chick
Consignment Agreement

1. Acceptance of Items

The Pickin' Chick reserves the right to accept or decline any item offered for consignment. Acceptance of a consignment appointment does not guarantee acceptance of every item presented.

2. Auction Timeline

Auctions generally take 30–45 days to process from the time items are received. Larger consignments or special circumstances may require up to 90 days.

3. Auction Method

Items will be offered for sale through online auctions conducted by The Pickin' Chick.

Unless otherwise approved by The Pickin' Chick, all items will begin with a $2 starting bid. Reserve prices are not routinely offered and will only be considered on a case-by-case basis at The Pickin' Chick's sole discretion.

The Pickin' Chick retains sole discretion regarding all aspects of the auction process, including but not limited to lotting, photography, descriptions, starting bids, reserve prices, scheduling, marketing, and auction format.

4. Consignment Guidelines

The consignor acknowledges that they have read and agree to follow The Pickin' Chick's current Consignment Guidelines, including policies regarding acceptable items, box lots, declined items, and retrieval requirements.

5. Lotting & Marketing

The Pickin' Chick has sole discretion to determine how items are photographed, described, grouped into lots, marketed, priced, and offered for sale.

If you are consigning a particularly valuable, rare, unique, or historically significant item, please notify us at the time of drop-off. While we make every effort to identify notable items, we may not recognize the significance of every piece without additional information from the consignor.

The consignor grants The Pickin' Chick permission to photograph, describe, advertise, and promote consigned items through online auctions, social media, websites, printed materials, and other marketing channels without additional compensation.

6. Auction Sales

Items are sold through competitive online bidding. The Pickin' Chick does not guarantee minimum bids, reserve prices, selling prices, bidder participation, buyer interest, or the final outcome of any auction unless agreed to in writing.

7. Commission & Fees

The consignor commission rate will be agreed upon by The Pickin' Chick and the consignor at the time of drop-off and documented on the consignor's intake receipt or consignment record.

The Pickin' Chick charges buyers a 15% Buyer's Premium, which is paid by the buyer in addition to the winning bid. The Buyer's Premium is retained by The Pickin' Chick and is not included in the consignor's settlement proceeds or commission calculation.

There are no upfront consignment fees unless otherwise agreed upon.

Pickup, hauling, labor, transportation, disposal, storage, or other special services requested by the consignor may be subject to additional fees. Any such fees will be disclosed to and approved by the consignor before being incurred whenever reasonably practicable.

Any agreed-upon commissions, fees, and other amounts owed to The Pickin' Chick will be deducted from the consignor's settlement proceeds.

If the consignor requests the return of any item after photography, research, cataloging, or listing preparation has begun, The Pickin' Chick reserves the right to assess a reasonable processing fee.

8. Settlement

Consignor proceeds will be paid after buyer payments have cleared, pickup and shipping have been substantially completed, and any applicable refunds, chargebacks, or payment disputes have been resolved.

Settlement payments are typically issued within three (3) to four (4) business days following auction pickup.However, depending on payment processing, shipping, buyer issues, or other circumstances, settlement may take up to one (1) week after auction pickup.

9. Non-Paying Buyers, Sales Adjustments & Refunds

A sale is not considered complete until payment has been received and the item has been picked up by the buyer or shipped, as applicable.

If a buyer fails to pay or complete the transaction, The Pickin' Chick reserves the right to cancel the sale, offer the item to a backup bidder, re-auction the item, or return the item to the consignor.

The Pickin' Chick also reserves the right to cancel a sale, issue a full or partial refund, or adjust the purchase price due to a material defect, condition issue, authenticity concern, cataloging error, undisclosed damage, or other similar discrepancy.

Any adjustment shall be reflected in the consignor's settlement proceeds. Consignor proceeds will only be paid on completed sales for which buyer payment has been successfully collected and the item has been picked up by the buyer or shipped.

10. Unsold, Unclaimed & Rejected Items

The Pickin' Chick reserves the right to group items into box lots, decline items, donate items, dispose of items, or require the consignor to retrieve items in accordance with the current Consignment Guidelines.

Items the consignor is required to retrieve must be picked up within the timeframe specified in the Consignment Guidelines. Items not retrieved within that timeframe may be donated, disposed of, or assessed applicable storage, moving, or disposal fees.

11. Ownership & Authority to Sell

The consignor represents and warrants that they are the legal owner of, or have the legal authority to consign, all items submitted for auction. The consignor agrees to indemnify and hold harmless The Pickin' Chick from any claims, losses, damages, or expenses arising from disputes regarding ownership or the authority to sell the consigned property.

12. Liability

The Pickin' Chick will exercise reasonable care in handling, storing, and marketing consigned property. However, the consignor acknowledges that consigned items are accepted at the consignor's own risk.

The Pickin' Chick shall not be liable for ordinary wear, concealed or inherent defects, mechanical failure, gradual deterioration, loss of value, accidental damage, theft, fire, water damage, natural disasters, or other events beyond its reasonable control, except where liability is required by applicable law.

13. Right to Refuse Service

The Pickin' Chick reserves the right to decline any consignment or discontinue accepting future consignments at its sole discretion.

14. Entire Agreement

This Consignment Agreement, together with the current Consignment Guidelines, constitutes the entire agreement between the parties and supersedes any prior discussions or representations.

15. Agreement

By signing below, the consignor acknowledges that they have read, understand, and agree to this Consignment Agreement and The Pickin' Chick's current Consignment Guidelines.
